Definition

This Addendum uses certain terms that have the meanings given to them in the Australian Act as follows.

"Personal Information" means any information or opinion, whether true or not, and whether recorded in a material form or not, about an identified individual or an individual who is reasonably identifiable. In general terms, this includes information or an opinion that personally identifies an individual either directly or indirectly.

"Sensitive Information" refers to information that may be classified as ‘sensitive information’ by its nature, or due to applicable regulations and industry standards and is further defined under the Australian Act to include information about an individual’s racial or ethnic origin, political opinions, professional or political or religious affiliations or memberships, sexual orientation or practices, criminal record, health, genetics and/or biometrics.

We do not collect Sensitive Information about you. If we collect your Sensitive Information, we will do so only with your consent, if it is necessary to prevent a serious and imminent threat to life or health or as otherwise required or authorised by law, including pursuant to the requirement of APP 3 (Collection of Solicited Personal Information). We take appropriate measures to protect the security of this information.

Usage of Personal Information

We only use the Personal Information provided for the purpose identified in the privacy policy, which is considered as a "Primary Purpose." If we use or disclose Personal Information for another purpose this is known as "the Secondary Purpose", we shall separately obtain consent from you for the Secondary Purpose in accordance with the Australian Act.

Retention of Personal Information

We retain your Personal Information for as long as necessary to fulfil the purposes for which is collected and to comply with any legal obligations. When your data is no longer needed, we shall securely delete or anonymise it.

Disclosure of Personal Information to overseas

Some of the third-party providers we disclose information to, or servers, are located abroad, including in Japan, the United States of America and Singapore.

Where we disclose Personal Information to third parties overseas we will take reasonable steps to ensure that data security and appropriate privacy practices are maintained. We will only disclose to overseas third parties if:

• you have given us your consent to disclose Personal Information to that third party or
• we reasonably believe that:
  (a) the overseas recipient is subject to a law or binding scheme that is, overall, substantially similar to the Australian Privacy Principles; and
  (b) the law or binding scheme can be enforced or
• the disclosure is required or authorised by an Australian law or court/tribunal order.

Your Rights

You have the following rights in connection with your Personal Information pursuant to the Privacy Act, which are further set out in the APPs:

• the right to know how information is collected and used;
• the right to access your Personal Information as set out in this addendum;
• the right to correct your Personal Information if you believe that the Personal Information we hold about you is inaccurate, out-of-date, incomplete, irrelevant or misleading;
• the right to anonymity and pseudonymity (where lawful and practicable);
• the right to data security;
• the right to restrict use and disclosure of Personal Information;
• the right to opt-out of direct marketing communications from us;
• the right to lodge a complaint with us, or, if you are not satisfied with our response, escalate your complaint to the Office of the Australian Information Commissioner (OAIC); and
• the right to be informed of cross-border disclosures.

Access to your Personal Information

You may access the Personal Information we hold about you and update or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing via email or post.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

In order to protect your Personal Information, we may require identification from you before releasing the requested information.

Inquiries and complaints

For complaints about how Sekisui House handles, processes or manages your Personal Information, please contact us using the contact information provided below. Note we may require proof of your identity and full details of your request before we can process your complaint. Please allow up to 24 days for Sekisui House to respond to your complaint.

If you are not happy with our response, you may complain directly to Office of the Australian Information Commissioner (OAIC).

Cookies

We use cookies, tracking pixels and similar technologies on our website and in our emails from time to time.

You can block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies.

You can block tracking pixels by using ad-blocking or privacy-focused browser extensions. Some email providers allow you to block images by default, which can prevent tracking pixels in emails from loading.

However, if you use your browser settings to block all cookies (including essential cookies) and tracking pixels, you may not be able to access all or parts of our website and you may not receive personalised content.

Amendments to this Addendum

We may vary this Privacy Policy due to changes in our privacy practices or changes in the law, regulations and/or professional standards. We will publish the amended addendum on our website.
